a strict selection process. Each candidate for employment undergoes
an extensive criminal background check and one or more thorough interviews.
Using the Department of Homeland Security’s E-Verify System,
JCS also confirms the identity of each employee and determines the
eligibility of each employee to work in the United States. Research
indicates that illegal immigrants generally are not “undocumented.” They
commonly possess bogus documents such as counterfeit social security
cards, forged drivers licenses, fake “green cards,” and
phony birth certificates. Experts believe that approximately 75 percent
of illegal aliens use counterfeit social security cards to obtain employment.
The E-Verify System helps JCS detect this fraud.
Most cleaning companies
choose to accept identification documents presented by employment
candidates at face value. Such companies elect to hide
their corporate heads in the sand and engage in the employment version
of “don’t ask, don’t tell.” JCS believes
this practice unnecessarily subjects our clients to unacceptable
risk and
potential legal liability. JCS uses the E-Verify System because this
practice mitigates our clients’ risk of harm and provides clients
with considerable peace of mind.
The benefits of E-Verify extend far
beyond stopping illegal aliens from committing document fraud and
identity theft. Employment verification
also prevents American citizens from using fraudulent documents
and stolen identities to obtain employment. Violent criminals and
serial
felons use fake identities and social security numbers to cover
up serious criminal convictions. These felons are exposed by E-Verify.
Recent events clearly support JCS’ decision to use E-Verify.
More than 1,200 janitors were fired in Minnesota when they were unable
to provide the U.S. Immigration and Customs Enforcement with proof
of their legal status in the United States. The vast majority of the
1,200 fired workers turned out to be "undocumented."
Another high profile case involved Wal-Mart Stores, Inc. Most American
businesses know that the Immigration Reform and Control Act of 1986,
8 U.S.C 1324a(1), specifically prohibits the hiring of an alien not
authorized to legally work in the United States. A much lesser-known
provision of this law, 8 U.S.C 1324a(4), provides that an entity
who uses a contract or subcontract to obtain the labor of an alien
knowing that the alien is an unauthorized alien with respect to performing
such labor, shall be considered to have hired the alien for employment
in violation of law. This provision is obscure no more, having been
brought to public attention thanks to a landmark settlement involving
Wal-Mart Stores, Inc. While avoiding criminal charges, the retail
giant agreed to pay a record $11 million in fines to the federal
government to resolve charges of the employment of illegal aliens
by the independent contractors it retained to provide janitorial
services. The settlement was the culmination of a series of raids
and investigations dating back to 1998, which resulted in the arrests
of over 350 allegedly illegal aliens. The twelve corporations that
hired the undocumented aliens and placed them in Wal-Mart stores
plead guilty to criminal immigration charges and agreed to pay a
further total of $4 million in fines.
